TERMS AND CONDITIONS

1. General Provisions

1.2 The online store offers dried flower bouquets, wreaths and other decorative floral arrangements.

1.3 By using the online store and purchasing products, the Customer confirms that they have read, understood and agreed to these Terms and Conditions.

1.4 When a Consumer purchases products through the online store, a distance contract is concluded between the Seller and the Customer. The distance contract is subject to the laws and regulations applicable in the Republic of Latvia, including the Consumer Rights Protection Law and the applicable regulations governing distance contracts.

1.5 These Terms and Conditions form an integral part of the distance contract.


2. Ordering Products

2.1 To purchase a product, the Customer selects the desired product, provides the required information and places the order through the online store.

2.2 Product images are for illustrative purposes only. As dried flowers are a natural material, the shape, size, colour, shade and arrangement of individual flowers may vary slightly from those shown in the product images.

2.3 The price of each product is indicated next to the respective product. VAT, where applicable, is included in the displayed price.

2.4 Before confirming the order, the Customer is shown the total order amount, including the product price and delivery costs, if applicable.


3. Payment

3.1 Orders can be paid using the Omniva Checkout payment solution and the payment methods available through it.

3.2 The processing of the order will begin after the payment has been received.

3.3 Omniva Checkout provides payment and delivery solution integration for the online store. Payment processing within the Omniva Checkout solution is provided by MakeCommerce (Maksekeskus AS).

3.4 If the Seller is objectively unable to fulfil an order, the Customer will be informed and any payment received for the unavailable product will be refunded.


4. Delivery

4.1 Products are delivered to the Omniva parcel locker or another delivery point selected by the Customer from the delivery options available in the online store.

4.2 Delivery costs and the estimated delivery time are displayed during the order process.

4.3 The delivery time may depend on the selected delivery method and the relevant delivery service provider.

4.4 Upon receiving the product, the Customer is advised to check the condition of the packaging and the product. If any damage is discovered, the Customer is advised to document the damage immediately and contact the online store.

4.5 If an ordered product is unavailable or delivery within the indicated period is not possible, the Seller will inform the Customer.

4.6 The Seller is not responsible for delivery delays caused by the delivery service provider or by circumstances beyond the Seller's reasonable control, to the extent permitted by applicable laws and regulations.


5. Right of Withdrawal

5.1 The Consumer has the right to withdraw from the distance contract within 14 days from the date of receipt of the product, in accordance with applicable laws and regulations.

5.2 To exercise the right of withdrawal, the Customer must inform the online store of their decision before the expiry of the withdrawal period by sending the withdrawal form (Withdrawaljjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjjj Form) to: [email protected].

5.3 After submitting the withdrawal notice, the Customer must return the product to the Seller without undue delay and no later than 14 days after notifying the Seller of the withdrawal.

5.4 During the withdrawal period, the Customer may inspect and handle the product only to the extent necessary to establish its nature, characteristics and functioning. The Customer is responsible for any decrease in the value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

5.5 The costs of returning the product shall be borne by the Consumer.

5.6 When the right of withdrawal is exercised, the Seller shall reimburse the Customer for the payments received, including the cost of standard delivery, within 14 days from the date on which the Seller receives the Customer's withdrawal notice. The Seller may withhold the reimbursement until the product has been received back or the Customer has provided evidence that the product has been sent back, whichever occurs first.

5.7 The right of withdrawal does not apply in cases specified by applicable laws and regulations, including products made according to the Consumer's specifications or clearly personalised products.

5.8 If the right of withdrawal does not apply to a particular product under applicable laws and regulations, the Customer will be informed of this before placing the order.


6. Non-Conforming Products and Product Defects

6.1 The Seller is responsible for ensuring that products conform to the terms of the contract and is liable for product defects to the extent and for the period provided by the applicable laws and regulations of the Republic of Latvia.

6.2 If the Customer discovers that a product does not conform to the terms of the contract or has a defect, the Customer has the right to submit a complaint to the Seller by contacting: [email protected].

6.3 Depending on the circumstances and applicable laws and regulations, the Customer may request that the non-conformity be remedied, that the product be replaced, that the price be reduced, or that the contract be terminated and the payment refunded.

6.4 The complaint should preferably include the order number, product name, description of the identified defect or non-conformity and, where necessary, photographs of the product.

6.5 The Seller will review the Customer's complaint and provide a response within the period prescribed by applicable laws and regulations.


7. Complaints and Dispute Resolution

7.1 If the Customer has a complaint or claim, it may be submitted to the online store in writing at: [email protected].

7.2 The online store will review the Consumer's complaint and respond.

7.3 The Seller and the Customer shall first attempt to resolve any disputes relating to an order, product or service through mutual discussions.

7.4 If a dispute cannot be resolved through mutual discussions, the Customer has the right to use the dispute resolution mechanisms provided by applicable laws and regulations, including contacting the Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs) or a court of competent jurisdiction.

7.5 Matters not specifically addressed in these Terms and Conditions shall be governed by the laws and regulations applicable in the Republic of Latvia.


8. Personal Data Protection

8.1 The online store processes the Customer's personal data to the extent necessary for accepting and processing orders, processing payments, arranging delivery and communicating with the Customer.

8.2 Personal data is processed in accordance with applicable personal data protection laws and regulations.

8.3 Detailed information about the processing of personal data is provided in the online store's Privacy Policy.


9. Copyright

9.1 Images, texts, design elements, logos and other content published on the online store are the property of the online store or are used with the appropriate rights.

9.2 The use, copying or distribution of the online store's content without prior permission is prohibited, except where permitted by applicable laws and regulations.


10. Amendments to the Terms and Conditions

10.1 The online store reserves the right to amend these Terms and Conditions by publishing the updated version on the online store.

10.2 The Terms and Conditions applicable to a particular order are those in force at the time the order is placed.

10.3 If substantial changes are made to these Terms and Conditions, the updated version will be published on the online store.
